Judge Diva Malerbi, from the Federal Regional Court of the 3rd Region, overturned a court order that prohibited the export of 27 thousand live cattle through the port of Santos (SP). In a decision on Sunday night (4/2), the judge responded to a request made by the Attorney General's Office on the same day.
The injunction B2B Lead banned the export of live animals throughout the national territory, on Friday (2/2). The new decision, however, only dealt with the specific case of 27 thousand cattle that were waiting to be sent to Turkey, from Santos.
According to the National Forum for the Protection and Defense of Animals, author of the action, during the wait they did not even have drinking water. For judge Djalma Moreira Gomes, from the 25th Federal Court of São Paulo, animals are subjects of law that must be protected.
Diva Malerbi, however, understood that maintaining the ban would cause more wear and tear to the animals than continuing the trip. The AGU said that compliance with the order would cause economic impacts on international trade and the Brazilian trade balance. Brazil exports an average of 600,000 animals per year.
According to the AGU, preventing the vessel from leaving proves to be much more “harsh” for the animals than the journey itself , since the ship cannot be cleaned on the Brazilian coast, for environmental reasons. “Therefore, it can only be cleaned, with animal feces removed from the ship on the high seas, with the use of specific equipment that uses seawater itself to clean the ship,” stated the AGU.
For the Union's attorney general, Grace Mendonça, the judge's decision “reestablishes legal certainty and preserves public health and animal welfare”.
